Welcome to ShiftSync TT

These Terms of Service ("Terms") govern your access to and use of ShiftSync TT, a cloud-based employee scheduling and workforce management platform operated by ShiftSync Services [COMPANY REGISTRATION NUMBER] ("we," "us," or "our"), a company registered in Trinidad & Tobago.

By creating an account, accessing, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

1. Eligibility and Account Registration

To use ShiftSync TT, you must:

  • Be at least 18 years of age
  • Be a business owner, manager, or authorized representative with authority to manage employee schedules
  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate and current
  • Be responsible for maintaining the confidentiality of your account credentials
  • Be responsible for all activities that occur under your account

You agree to immediately notify us of any unauthorized use of your account or any other security breach.

2. Subscription Plans and Pricing

ShiftSync TT operates on a paid subscription model with the following plans:

Basic Plan

TTD $299/month

Essential scheduling features for small teams

Premium Plan

TTD $699/month

Advanced features including AI scheduling, time clock, and payroll tools

Payment Terms:

  • Subscriptions are billed monthly in advance
  • All fees are quoted in Trinidad & Tobago Dollars (TTD)
  • Payment is due on the first day of each billing cycle
  • We accept major credit cards and local payment methods available in Trinidad & Tobago
  • Subscriptions automatically renew unless canceled before the next billing date
  • We reserve the right to change our pricing with 30 days' notice to subscribers
  • All fees are non-refundable except as described in our Refund Policy below

7-Day Money-Back Guarantee:

If you are not satisfied with ShiftSync TT, you may cancel your subscription within 7 days of your initial purchase for a full refund. To request a refund, contact us at support@shiftsynctt.com within the 7-day period. This guarantee applies only to your first subscription purchase and does not apply to renewals.

Cancellation:

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the service until the end of the paid period. No refunds or credits will be provided for partial months of service.

3. Service Description and Scope

ShiftSync TT provides the following features:

  • Employee scheduling and shift management
  • Time clock and time tracking (Premium plan)
  • Payroll calculation assistance (Premium plan)
  • AI-powered schedule generation (Premium plan)
  • Employee management and role assignment
  • Shift swap and time-off request workflows
  • Notifications and calendar integrations
  • Reporting and analytics

We reserve the right to modify, suspend, or discontinue any feature or functionality of the service at any time with reasonable notice to subscribers.

4. Data Protection, Privacy, and Retention

Data Collection and Use:

We collect and process personal data necessary to provide our services, including employee names, contact information, work schedules, time clock data, and payroll information. We use this data solely to provide and improve our services.

Data Protection:

We implement industry-standard security measures to protect your data, including encryption in transit and at rest, secure authentication, and regular security audits. We comply with the Data Protection Act of Trinidad & Tobago.

Data Retention:

  • Active Accounts: We retain your data for the duration of your active subscription
  • Canceled Accounts: After cancellation, we retain your data for 90 days to allow for reactivation
  • Backup Retention: Backup copies may be retained for up to 180 days for disaster recovery purposes
  • Legal Requirements: We may retain data longer if required by Trinidad & Tobago law or for legitimate business purposes (e.g., dispute resolution)

Your Data Rights:

  • Access: You may access and export your data at any time through your account settings
  • Deletion: You may request deletion of your data by contacting support@shiftsynctt.com. We will delete your data within 30 days, except where retention is required by law
  • Correction: You may update or correct your data through your account settings
  • Portability: You may export your data in CSV or JSON format

Data Sharing:

We do not sell your personal data to third parties. We may share data with service providers necessary to operate our service (e.g., cloud hosting, email delivery) under strict confidentiality agreements. We may also disclose data if required by law or to protect our legal rights.

5. Disclaimers and Liability Limitations

⚠️ IMPORTANT: Please Read Carefully

ShiftSync TT is a scheduling and workforce management TOOL. You are solely responsible for verifying all calculations, ensuring legal compliance, and making final business decisions.

Payroll Calculation Disclaimer:

The payroll calculation features are provided as a convenience and assistance tool only. While we strive for accuracy, YOU ARE SOLELY RESPONSIBLE for:

  • Verifying the accuracy of all payroll calculations before processing payments
  • Ensuring compliance with Trinidad & Tobago employment laws, including minimum wage requirements
  • Calculating and remitting proper deductions for NIB (National Insurance Board), PAYE (Pay As You Earn), and other statutory requirements
  • Maintaining accurate time and attendance records
  • Handling disputes regarding pay and hours worked

We strongly recommend consulting with a qualified accountant or payroll specialist for all payroll matters. WE ARE NOT RESPONSIBLE for any payroll errors, miscalculations, or resulting financial losses.

Labor Law Compliance Disclaimer:

YOU ARE SOLELY RESPONSIBLE for ensuring your business practices comply with all applicable laws of Trinidad & Tobago, including but not limited to:

  • The Minimum Wages Act
  • The Retrenchment and Severance Benefits Act
  • The Occupational Safety and Health Act
  • The Equal Opportunity Act
  • National Insurance Act (NIB registration and contributions)
  • Income Tax Act (PAYE deductions and remittances)
  • Employment regulations regarding overtime, breaks, and working hours

ShiftSync TT does not provide legal or compliance advice. Consult with a qualified attorney or labor law specialist for guidance on Trinidad & Tobago employment laws.

Time Clock Data Disclaimer:

While our time clock feature records punch times, you are responsible for:

  • Verifying the accuracy of employee clock-in and clock-out times
  • Investigating and resolving discrepancies
  • Ensuring employees are clocking in/out properly
  • Maintaining backup time and attendance records as required by law

AI Scheduling Disclaimer:

Our AI-powered schedule generation provides suggestions based on your business hours, staffing requirements, and employee availability. These are RECOMMENDATIONS ONLY. You are responsible for:

  • Reviewing and approving all AI-generated schedules before publication
  • Ensuring adequate staffing levels for your business needs
  • Complying with employee availability, time-off requests, and labor law requirements
  • Communicating schedules to employees in a timely manner

6. Service Availability and Uptime

We strive to provide reliable, uninterrupted access to ShiftSync TT. However, we do not guarantee 100% uptime or continuous availability. Our services may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency maintenance or security updates
  • Third-party service provider outages (e.g., cloud hosting, internet connectivity)
  • Force majeure events beyond our reasonable control
  • DDoS attacks or other security incidents

No SLA Guarantee: We do not provide a Service Level Agreement (SLA) or uptime guarantee. We are not liable for any losses, damages, or business interruptions resulting from service downtime or unavailability.

Data Backup: While we maintain regular backups of our systems, we strongly recommend you export and maintain your own backup copies of critical business data (schedules, employee information, time records, etc.).

7. Acceptable Use Policy

You agree not to use ShiftSync TT to:

  • Violate any laws or regulations of Trinidad & Tobago or any other jurisdiction
  • Infringe on intellectual property rights or violate privacy rights of others
  • Upload malicious code, viruses, or harmful software
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated systems (bots, scrapers) to access the service without permission
  • Reverse engineer, decompile, or disassemble any part of the service
  • Resell, sublicense, or provide unauthorized access to the service
  • Use the service for any illegal or fraudulent purposes
  • Harass, abuse, or harm others through the service

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

8. Intellectual Property Rights

ShiftSync TT, including all software, designs, text, graphics, logos, and trademarks, is the intellectual property of ShiftSync Services and is protected by copyright, trademark, and other intellectual property laws of Trinidad & Tobago.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service for your internal business purposes only.

You retain all rights to your business data (employee information, schedules, time records, etc.) that you input into the service. By using our service, you grant us a license to use, store, and process your data solely for the purpose of providing and improving our services.

9. Account Termination and Suspension

Termination by You:

You may cancel your account at any time through your account settings. Upon cancellation, you will retain access until the end of your current billing period, and your data will be retained for 90 days as described in Section 4.

Termination or Suspension by Us:

We may suspend or terminate your account immediately and without notice if:

  • You violate these Terms of Service
  • Your payment method fails or your account becomes delinquent
  • We are required to do so by law
  • We believe your account poses a security risk
  • We discontinue the service entirely (with 30 days' notice)

Effect of Termination:

Upon termination, your right to access and use the service immediately ceases. You remain responsible for all fees incurred before termination. We will retain your data according to our data retention policy (Section 4).

10. Limitation of Liability

IMPORTANT LEGAL NOTICE

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF TRINIDAD AND TOBAGO:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL SHIFTSYNC SERVICES, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Errors in payroll calculations or employment law compliance
  • Service interruptions, downtime, or data loss
  • Unauthorized access to or alteration of your data
  • Actions or inactions of third parties or your employees

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR TTD $1,000, WHICHEVER IS LESS.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. You may have additional rights under the laws of Trinidad & Tobago.

11. Indemnification

You agree to indemnify, defend, and hold harmless ShiftSync Services, its directors, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from or related to:

  • Your use or misuse of the service
  • Your violation of these Terms
  • Your violation of any laws or regulations of Trinidad & Tobago
  • Your violation of any third-party rights (including employment rights)
  • Any disputes with your employees regarding pay, hours, or working conditions
  • Your failure to comply with employment laws or NIB/PAYE requirements
  • Any data or content you submit to the service

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Trinidad & Tobago, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of Trinidad & Tobago.

Informal Resolution: Before initiating any legal action, you agree to first contact us at support@shiftsynctt.com to attempt to resolve the dispute informally. We will work in good faith to resolve any issues.

13. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Notify you via email or through an in-app notification
  • Provide at least 30 days' notice before the changes take effect

Your continued use of the service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must cancel your subscription before the effective date.

14. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ShiftSync Services regarding the service.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Notices: We may provide notices to you via email to the address associated with your account or through the service. You agree that electronic notices satisfy any legal requirement that notices be in writing.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or internet/telecommunications failures.
